1. Introduction
These Terms and Conditions govern the use of this website and the engagement of services provided by Injaz Al Shohab Digital Marketing (“we”, “us”, or “the provider”). By using this website or engaging our services, you agree to be bound by these terms.
Specific engagements may be governed by additional written proposals or agreements signed between us and the client. Where those documents conflict with these terms, the specific signed proposal or agreement prevails for that engagement.
2. Acceptance of terms
Browsing this website, contacting us, or accepting a proposal constitutes acceptance of these Terms. If you do not agree, you should not use the website or engage our services.
We may update these Terms from time to time. The current version is always the one published at this URL.
3. Nature of services
Injaz Al Shohab Digital Marketing provides digital marketing and automation services, including but not limited to paid advertising management, social media management, search engine optimization, content writing, landing page design, conversion-rate optimization, reporting and analytics, and marketing automation.
Specific services included in any engagement are defined in the written proposal accepted by the client.
4. Service requests and communication
Service requests are typically initiated through WhatsApp, phone, or email. Initial discussions and discovery calls are conducted without commitment. Engagement begins only after a written proposal is accepted by both parties.
During an active engagement, day-to-day communication usually runs through WhatsApp and scheduled calls. Important decisions and approvals are confirmed in writing.
5. Scope of work
The scope of work for any engagement is set out in the accepted written proposal. Work outside that scope — additional services, additional channels, additional creative volume, additional revisions — may be quoted separately or treated as a new engagement.
We will not perform work outside the accepted scope without prior written agreement. This protects both sides from unexpected costs and expectation mismatches.
6. Pricing and offers
Management fees are quoted as fixed monthly amounts in the proposal, based on the scope of work. Advertising budgets — amounts paid directly to Google, Meta, or other ad platforms — are always quoted separately and are not part of our management fee.
Prices on the website are indicative only unless they appear in a written proposal addressed to a specific client. Special offers or promotions are valid only for the period stated in writing.
7. Client responsibilities
Clients agree to provide accurate information about their business, audience, and goals; to grant access to the systems needed to deliver the work (for example, ad accounts, hosting, CMS); to review and approve deliverables within agreed timeframes; and to make payments according to the schedule in the proposal.
Delays in providing access, content, or approvals may delay the project and may shift the agreed timeline.
8. Provider responsibilities
We agree to deliver the services described in the accepted proposal with professional care and reasonable diligence, to communicate transparently about progress and challenges, to keep accounts and assets under the client's ownership, and to share reports as defined in the proposal.
We do not commit to specific business outcomes that we cannot control — see "No guaranteed marketing results" below.
9. Timelines and revisions
Timelines are estimated in good faith based on typical workflows and the information available at the start of the engagement. Significant changes to scope, delays from the client side, or unforeseen platform issues may extend timelines.
Each deliverable typically includes a defined number of revision rounds, as set out in the proposal. Additional revisions beyond that may be quoted separately.
10. Limitation of liability
To the maximum extent permitted by applicable law, our liability for any claim arising out of an engagement is limited to the amount of fees paid by the client for the specific service to which the claim relates.
We are not liable for indirect, incidental, or consequential damages, including but not limited to lost profits, lost data, or reputational harm.
11. No guaranteed marketing results
Marketing results — leads, sales, rankings, return on ad spend, social media growth — depend on many variables that are not under our exclusive control, including the offer, audience, budget, competition, creative, ad platform behavior, and the client's own follow-up.
We do not guarantee any specific number of leads, sales, conversions, rankings, ROAS, or any other business outcome. We commit to professional execution, transparent reporting, and continuous optimization. Anyone who guarantees specific marketing outcomes is either misrepresenting or misunderstanding how digital marketing works.
12. Intellectual property
Final approved deliverables — ads, landing pages, copy, creative assets — produced under an engagement are owned by the client once invoices for that engagement have been paid in full.
Internal tools, templates, methodologies, and know-how we use to produce the work remain our property. We may showcase publicly visible deliverables (for example, a live landing page) as part of our portfolio unless the client explicitly requests otherwise in writing.
13. Use of materials and content
Clients warrant that any materials provided to us — logos, photos, videos, copy, customer testimonials — are either owned by the client or used with proper permission. The client is responsible for ensuring that materials they supply do not infringe third-party rights.
We will respect the confidentiality of non-public information shared with us during an engagement and use it only for the purpose of delivering the agreed services.
14. Third-party tools
Our work often involves third-party platforms — including but not limited to Google Ads, Meta Ads, Google Analytics, Search Console, WhatsApp Business API, CRMs, hosting providers, and analytics tools.
Each of those platforms has its own terms of service, policies, fees, and downtime. We are not responsible for changes those providers may make, policy violations by the client, account suspensions, or platform outages outside our control.
15. Terms updates
We may update these Terms from time to time. The current version is always the one published at this URL. Material changes will be highlighted at the top of this page for a reasonable period after they take effect.
Continued use of the website or our services after an update constitutes acceptance of the updated Terms.
